He attacked his wife in the ski resort last Christmas and has been jailed for 30 days. On Monday he hears if he can do voluntary work in a local theatre.
He physically attacked his wife, Brooke Mueller, at their skiing lodge in the upmarket US ski resort.
Aspen is host to many Hollywood stars.
The attack happened on Christmas Day and we reported on it on PlanetSKI within this story.
The 44-year old actor, star of Two and Half Men and numerous Hollywood films, is asking to take up a post at Theatre Aspen as part of his punishment.
The local police have already agreed that it would be beneficial for him to raise funds for the theatre and coach actors in the ski resort.
A judge though will make the final decision.
We'll let you know the outcome.
